Darien Police say they responded to a report of a disturbance in the area of Center Street on Sunday, Sept. 22 around 2:45 a.m.
The victim allegedly told police that he had been pushed, punched and choked by the suspect.
Further investigation led to the discovery of a man that matched the description of the suspect, identified as Robby Tuttle, 28, of Stamford, sitting on a bench next to CVS on Post Road.
When asked about the altercation, police say Tuttle stated that there is “always fighting at Ernie’s.” Tuttle also appeared intoxicated and his clothes were disheveled, according to police.
While talking with Tuttle, police say an Uber arrived and he tried to enter. Upon being told that he was not free to leave until the investigation was finished, the Uber left the scene, causing Tuttle to become “angry and aggressive” toward the officer, according to police.
Tuttle allegedly became physical with the officer as he was being detained. A second officer arrived and helped get Tuttle into handcuffs, police say.
Even while handcuffed, police say Tuttle continued to resist officers and refused to enter the patrol vehicle. He was eventually transported to headquarters, where he was charged with third-degree assault and interfering with an officer.
Tuttle was held on a $25,000 bond and was transported to court on Monday, Sept. 23.
